These Terms of Use ("Terms") govern your access to and use of wizhealth.com and any other website operated by Wiz Health, LLC that links to these Terms (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms apply to the public marketing Site. Wiz software, implementation, support, and other paid services are governed by the separate agreement between Wiz and the applicable customer. If that agreement conflicts with these Terms regarding paid services, the customer agreement controls.
Who may use the Site
You must be at least 18 years old and able to enter into a binding agreement to use the Site. If you use the Site for a company or other organization, you represent that you have authority to bind that organization to these Terms.
About the Site
The Site provides general information about Wiz, its products, and topics related to eligibility, patient estimates, prior authorization, and revenue-cycle operations. Site content may be changed, corrected, suspended, or removed at any time.
No medical, legal, or billing advice
Site content is provided for general business and informational purposes only. It is not medical, clinical, legal, coding, reimbursement, insurance, or financial advice and should not be relied on as a substitute for professional judgment. Use of the Site does not create a patient-provider, attorney-client, payer-provider, or fiduciary relationship with Wiz.
Marketing-site scope
The Site is a public marketing website for Wiz's business software. It is not the Wiz application, a patient portal, or a clinical intake service. Use Site forms only for business inquiries, and do not include patient records or other sensitive health information in a message.
Permitted use
Subject to these Terms, Wiz grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful internal business and informational purposes.
Prohibited conduct
You may not misuse the Site or help another person do so.
- Violate law, another person's rights, or these Terms.
- Submit false, misleading, unlawful, infringing, harmful, or confidential third-party information.
- Upload malware or attempt to gain unauthorized access to the Site, accounts, systems, or data.
- Probe, scan, overload, disrupt, or circumvent Site security, access controls, rate limits, or robots directives.
- Scrape, harvest, copy, frame, mirror, or use automated means to access the Site except as expressly allowed by Wiz or applicable law.
- Reverse engineer or attempt to derive source code from Site software except where that restriction is prohibited by law.
- Use the Site to build or train a competing product or to impersonate Wiz or another person.
Demo, contact, and sample requests
When you submit a demo or contact form, we use the business contact and inquiry information you provide to respond to that request. Each resource-download form asks for the minimum business contact information shown on the form and includes an optional email follow-up choice. You may uncheck that choice and still receive the requested resource. You are responsible for providing accurate information that you are authorized to share. Any marketing beyond responding to an active request is subject to the choices and opt-out rights described in our Privacy Policy.
Examples, estimates, and results
Any sample patient estimate, workflow, calculation, return-on-investment figure, case study, testimonial, or performance result shown on the Site is illustrative. Actual eligibility responses, benefit details, patient responsibility, payer behavior, reimbursement, collections, implementation timing, and business results vary. Except for the 3× Savings Guarantee governed by the separate 3× Savings Guarantee Terms, nothing on the Site is a guarantee, binding quote, coverage determination, or promise of a particular result.
Intellectual Property
The Site and its content, including its text, graphics, software, designs, and other materials, are owned by or licensed to Wiz Health, LLC and are protected by applicable intellectual-property laws. WIZ™, WIZ HEALTH™, and associated logos are trademarks of Wiz Health, LLC. You may not use these marks without the prior written permission of Wiz Health, LLC. Third-party names and trademarks remain the property of their respective owners.
Feedback
If you voluntarily provide ideas or feedback about the Site or Wiz products, you grant Wiz a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. Do not submit feedback you are not authorized to provide.
Third-party services and links
The Site may link to or rely on third-party websites, videos, reports, scheduling tools, analytics providers, or other services. Wiz does not control and is not responsible for third-party content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider's terms and policies.
Privacy
Our Privacy Policy explains how we handle personal information collected through the Site. By using the Site, you acknowledge the processing described in the Privacy Policy.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL SITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WIZ HEALTH DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WIZ HEALTH DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZ HEALTH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF WIZ HEALTH AND THOSE PARTIES FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Wiz and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from your misuse of the Site, your violation of these Terms, or information you submit in violation of another person's rights.
Suspension and termination
Wiz may suspend or terminate your access to the Site at any time if we reasonably believe you violated these Terms, created risk or legal exposure, or threatened the Site's security or operation. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, liability limits, indemnification, and governing law.
Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from the public Site or these Terms must be brought exclusively in the state or federal courts located in El Paso County, Texas, and you consent to their jurisdiction and venue, except where applicable law does not permit this choice.
Changes to these Terms
We may update these Terms by posting a revised version and changing the last-updated date. Changes apply prospectively when the revised Terms become effective. Your continued use of the Site after that date constitutes acceptance of the revised Terms.
General terms
These Terms and the Privacy Policy are the entire agreement regarding use of the public Site, except that a separate written agreement controls the services it covers. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Wiz may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
